 From what I can remember, the original Eolas patent applied to the  
use of HTML object/embed tags to embed plugins directly within an HTML  
page - this was trivially easy to get around by using Javascript to  
write out the object/embed tags rather than having them in the HTML.

Follow up patents sounds bad, though. :-(
