the capsLockKey function - not working?

I am using a Toshiba Satellite US keyboard (laptop) and I cannot get the  
capsLockKey function to return anything other than "up" - even when the caps  
lock is on or I physically hold down the key. Has anyone else seen this or have  
a solution?

Incidentally, I will be releasing a beta version of my ScrapDiary
