On the "pricing" page of the Livecode site, towards the bottom, there is an FAQ.
The first question there is indeed what you are asking.
The answer given is:
"To build closed source apps you must have a valid current Indy, Business or other commercial license. If you do not renew this license your access to LiveCode will revert to the Open Source edition and you will no longer be able to build closed source apps."

Fairly clear.
