Scott, this is definitely an annoyance that Apple has created with OSX.
try this approach

 answer folder ""
set the defaultfolder to it
answer there is a file ".ds_store"
delete file ".ds_store"
answer there is a file ".ds_store"

--now make a new folder there, and bingo.. another .ds_store file :-(

FinderCleaner
FinderCleaner cleans hidden files the Finder creates. These files can be
